Foulston Siefkin Client Awarded $12.6 Million in Contract Litigation

A Kansas City, Kansas federal court jury has returned a $12.6 million verdict in favor of Radiologix, Inc. and Radiology and Nuclear Medicine Imaging Partners, Inc. (RadNet) against Radiology and Nuclear Medicine, LLC, a Topeka physician group (RNM). On Feb. 22, the jury found that the physician group had wrongfully terminated its management agreement with RadNet and, in addition to awarding RadNet $12.6 million in damages, denied the physician group’s counterclaim for $7 million. Foulston Siefkin LLP partners Scott Nehrbass and Jim Armstrong represented RadNet in the 11-day trial.
“The jury agreed that RNM had no legitimate grounds for terminating the contract and found that our clients were entitled to nearly all of the lost profits calculated by our expert,” Mr. Nehrbass said. “Our client appreciates the jury’s service and believes justice has been done.”
