Holly A. Dyer, Partner


Ms. Dyer’s practice encompasses a wide range of litigation matters, including actions concerning commercial transactions, contract disputes, noncompetition clauses, trade secrets, business torts, professional malpractice, government investigations, and administrative decisions and appeals. Ms. Dyer has been selected by her peers for inclusion in the Missouri & Kansas Super Lawyers® list and The Best Lawyers in America© for her work in the areas of Commercial Litigation, Professional Malpractice Law, Medical Malpractice Law, and Personal Injury Litigation. In 2015, Benchmark Litigation named Ms. Dyer a “Local Litigation Star” and one of the Top 250 Women in Litigation in the United States.

Ms. Dyer has served as President of the Wichita Bar Association and is a member of the Wichita Bar Association’s Ethics and Grievance Committee. Ms. Dyer also serves on the Firm’s Ethics Committee. She is a member of the American Law Institute.

Outside of her law-related activities, Ms. Dyer is a member of the Wichita State University Alumni Association Board of Directors and Executive Committee.

  • Successful representation of national church in dispute between church and local congregants over ownership of church property – injunction and damages award in favor of national church upheld on appeal. Church of God in Christ, Inc. v. Board of Trustees of Emmanuel Church of God in Christ, Wichita, Kansas, 47 Kan. App. 2d 674, 280 P.3d 795 (2012).

  • Successful administrative agency appeal by three community colleges involving complex funding scheme for career technical education. Dodge City Community College v. Kansas Board of Regents, 2009-C-1046 (3d Judicial District, Shawnee County).

  • Successful representation of large charitable hospital in action involving whether Kansas Consumer Protection Act applied to hospital’s assertion of statutory hospital lien. Summary judgment decision in hospital’s favor affirmed by Kansas Court of Appeals and currently being reviewed by Kansas Supreme Court. Via Christi Regional Medical Center, Inc. v. Reed, 45 Kan. App. 2d 356, 247 P.3d 1064 (2011).

  • Successful defense in lower court and on appeal of developmental services provider in wrongful death action. Berthelson v. Developmental Services of Northwest Kansas, 2006 WL 3774332 (Kan. Ct. App. Dec. 22, 2006).

  • Successful defense at trial of medical director of air ambulance service in medical negligence claim involving death of mother of three following air transport from rural hospital to tertiary care facility. Garcia v. Sellberg, et al., U.S. District Court Kansas, Case No. 04-1159-MLB.

  • Successful defense on summary judgment and on appeal of major printer and ink cartridge manufacturer in class action brought for fraud and violation of Kansas Consumer Protection Act. Cole v. Hewlett Packard, Wyandotte County District Court, Case No. 01 C 2344, aff'd 84 P.3d 1047 (Kan. Ct. App. 2004) (per curiam).

  • Successful defense of anesthesiologist after nine-week trial in medical negligence claim involving a birth injury with damage allegations in excess of $15 million. Haley v. Yoon, Sedgwick County District Court, Case No. 03 CV 609.

  • Successful defense of mortuary and funeral director on summary judgment and on appeal in claim for negligent and intentional mishandling of a dead body. Ely v. Hitchcock, 30 Kan. App. 2d 1276, 58 P.3d 116 (2002).

  • Successful defense in two trials and on appeal of physician in medical negligence claim involving brain-damaged child with damage allegations in excess of $25 million. Irvin v. Smith, 272 Kan. 112, 31 P.3d 934 (2001).

  • Defense of national corporation in complex trade secret litigation arising from federal targeted jobs tax credits program.
